Our mission is to bring you an affordable, flexible and comprehensive online education while establishing a collaborative environment between instructors and students. We believe that our learning platform is the best way to unleash your full potential in your learning and teaching journey. The Eduemore website and service including (without limitation) mobile applications and other interactive features through which the service is delivered (collectively, the “Service”) are owned and operated by Eduemore (referred to as “Eduemore” or “we”).
If you wish to register, access and use our Services, you must agree to these terms and conditions (“Terms of Service”). We also provide information regarding terms and conditions with respect to the processing of personal data of our students and instructors in our Privacy Policy. If you wish to publish an educational lesson or content on the Eduemore platform, you must agree to the Instructor Terms. Additionally, if you are a business to business purchaser of Eduemore for a group of users, your access and use of the Service are subject to the Master Services Agreement.
By registering, accessing and using our Services, you are agreeing to all these terms and conditions and any other legal documents published by us on the Service (collectively referred to as the “Governing Documents”). If you do not agree to any of these terms and conditions, you should not register for or use the Service. These Terms of Service apply to all users including users who are viewing the content of our platform and users who have registered as members of Eduemore.
These Terms of Service were last modified on December 1, 2020.
The Eduemore is an online learning platform which allows students to find out and select suitable educational lessons that they are interested in learning and conversely, allows instructors to find out students interested in taking their educational contents and lessons. At any time, we reserve absolute right to decline the request to grant the access to any student or instructor for any reason and to discontinue the Service with Eduemore in whole or part with or without prior notice.
You need to have Eduemore user account for all the activities as a student or instructor on our platform. These activities may include purchasing and enrolling in a lesson or publishing a lesson, etc. When setting up and maintaining your account, you must provide and maintain accurate and complete information including a valid email address and mobile number. You have absolute responsibility for the activities of your user account, including for any harm or damage to us or anyone else caused by someone using your account with or without your permission.
The following terms apply to your use of the Service and any account that you may open or attempt to open on our platform:
1. You must be a human to open an account. Accounts registered by automated methods are not permitted.
2. You are responsible for maintaining the security of your user account and password. We always consider any actions taken by your account as taken by you. Failure to comply with this security obligation, shall not create any additional liability, any loss, or damage on us.
3. You may not transfer your account to someone else, allow someone else to use your account, or use someone else’s account without getting our prior approval. If you request us access to an account, we will not grant you such access until you can provide us with the information that we need to prove you are the authorized user of that account. You can terminate your account at any time and check our Privacy Policy to understand the consequences when you terminate your account. In the event of the death of any user, such user account will be closed by Eduemore.
Eduemore is a community of thousands of learners and instructors. When you sign up for our platform, you agree to the following terms and conditions:
1. You shall use the Service only for lawful purposes and agree to not use the Service in any way that will infringe upon the use or rights of any other user.
2. You shall not upload any copyrighted, trademarked, or proprietary materials on our platform or post any content that infringes on any patent, trademark, trade secret, copyright, right of publicity, or other intellectual property or proprietary right of any other party without the expressed permission of the owner.
3. You assume full responsibility and ownership for the content of the Service offered.
4. You understand that lessons posted are publicly available to be viewed and accessed by any student.
5. Your use of the Service is subject to all applicable laws and regulations, and you are solely responsible for the substance of your communications through the Service.
6. You shall not share content from the Service with anyone who is not properly licensed to access the content.
7. You agree that you will not engage in any behavior that constitutes unauthorized or unsolicited advertising, spamming, chain letters, any form of lottery or gambling, or any other form of unauthorized solicitation.
8. You shall not upload, share, post, distribute or otherwise partake in any behavior that is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit descriptions of sexual acts, or any other that violates our rules or policies.
9. You will not partake in any behavior that victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability.
10. You shall not impersonate any person or entity, including any of our employees or representatives.
11. You shall not share software viruses or any other computer code, files, or programs that are designed or intended to obtain unauthorized access to any information or to disrupt, damage, or limit the functioning of any hardware, software, or any other equipment of our platform.
12. You will not use your account to breach security of another account or attempt to gain unauthorized access to another network or server. Users who create threats to and violate our systems or network security may incur criminal or civil liability.
When you publish a lesson on our platform, you agree to the following rules:
1. You will honor any enrollments through eduemore.com at the price and time listed in the Service, and not refuse enrollments or participation by any student for any discriminatory or other illegal reason.
2. You grant us the right to place advertisements on your lessons and content at our sole discretion.
3. Any content, you submit to the Service, will not contain third party copyrighted material, or material that is subject to other third-parties’ proprietary rights, unless you have permission from the rightful owner of the material.
4. You represent and warrant to Eduemore that you are qualified to create the lesson that you list with the Service and that you will always conduct yourself in compliance with all applicable laws.
5. You understand that, if you publish a lesson, your students will have the ability to post a review of this lesson. We cannot control the content of reviews made by our students and will not be held responsible for those opinions and comments.
6. You may decide to remove content from your lesson and will continue to own such content, but we will continue to have the right to use that content and to provide it to students who have already enrolled in and paid for your lesson.
7. You grant us full ownership of any video content and it is at our sole discretion to remove, edit, add, or publish that video content.
8. You agree that you will not submit any learning content to Eduemore that violates the Eduemore’s community and course content guidelines, which may be occasionally updated.
9. Eduemore reserves the right to, but is under no obligation, to delete the listing of any lesson at any time and for any reason.
When you enroll in a learning lesson as a student on our platform, you agree to the following rules:
1. You will accept all of the terms and conditions including the cancellation policy listed in the Service when you agree to enroll in or access a lesson on Eduemore.
2. You will follow all reasonable rules set by an instructor with respect to a lesson, and you will not take any actions to interfere with the instructor or any other students.
3. You may access lesson content for your personal use only.
4. You will not copy any materials or teaching techniques of your own or others’ lessons, or for interfering with any lesson or the instructor’s ongoing relationship with any students.
5. Eduemore reserves the right to delete or suspend your account if you violate any of our rules, or at any time and for any reason.
The educational content and lessons, you publish as a student or an instructor remain yours on our platform. By publishing such, you allow Eduemore to reuse and share those lesson and educational content. However, you do not lose any ownership rights you may have over your content. If you are an instructor, you should understand the lesson licensing terms that are detailed in the Instructor Terms. As a student, when you enroll in a lesson, you get a license from us to access and watch the lesson or content for a specific period and, but it should not be used for other use. You may print and download learning material of the Service solely for your own educational purpose provided that you agree not to change or delete any copyright or proprietary notices from the materials. You should not also to share any educational material that you paid for, with anyone else who has not purchased a license for that material.
You shall not use any extraction tools or data mining tools to collect or copy any content or information related to the Service unless it is authorized by Eduemore in writing. You must also not engage in unauthorized activities such as “database scraping”, “screen scraping” or any other activity to obtain information from our databases, or other lists or information from the Service. You must not use framing techniques to enclose any trademark, logo or other proprietary information of Eduemore unless it is authorized by Eduemore in written. You hereby grant to Eduemore a worldwide, royalty-free, non-exclusive, perpetual license, with the right to sub-license, reproduce, distribute, transmit, create any other work using it, publicly advertise and grant access to our users any materials or information you communicate to Eduemore by all means and in any media now known or hereafter developed. You also grant to Eduemore the right to use your name in connection with the submitted materials and other information as well as in connection with all advertising, marketing and promotional material related thereto. You understand and agree that you shall have no recourse against Eduemore for any alleged or actual infringement or misappropriation of any proprietary right in your communications to Eduemore.When a student enrolls in a lesson on Eduemore, student’s profile details are visible to the instructor. By enrolling in a lesson on Eduemore, a student grants us the permission to share that student’s information with the instructor. The instructor is always required to respect and protect the privacy of the students. The instructor has a limited authority to use this information only for Eduemore-related activities. The instructor shall not use that personal information for sending unsolicited commercial messages or unauthorized transactions. Without consent from that person, you must not misuse any student’s personal information.
All users must note that that you need to comply with all relevant legal rules when you use Eduemore. This includes applicable data protection and privacy laws which govern the ways in which you can use another Eduemore user’s information.In addition to these Terms of Service and the Governing Documents, an instructor and student may enter into Class Agreement in connection with a lesson. Students and instructors are each responsible to the other for complying with the terms of the Class Agreements, but Eduemore has no control over either party’s compliance. Among other things, Eduemore cannot control (a) the provisions of the Class Agreements, (b) the accuracy or legality of the Class Agreements or (c) any party’s performance of its obligations under the Class Agreements. Accordingly, Eduemore shall not be held responsible for any liability arising out of the Class Agreements or any actions that you may take in reliance thereon.
We reserve the right to change any fees or charges for using any platform or Services at any time. Except as otherwise expressly provided in these Terms of Service, any fee changes to your service will take effect following email notice to you. Instructor payments
1. Instructors may earn revenue by publishing lessons through Eduemore. Eduemore pays instructors before the 10th day of each month. Payouts sent on the 10th of each month are for transactions that have occurred in the previous calendar month.
2. Eduemore distributes 80% of its net revenue from the enrollments of the students on a monthly basis. The algorithm used to determine your monthly share is based primarily on the total number of student enrollments in your lesson through the platform. This distribution percentage is subject to change from time to time at the discretion of Eduemore.
3. Instructors have 10 days from the time at which a payment was made to report any discrepancies. After 10 days, you have waived your right to dispute any instructor payment. Any discrepancies with respect to the amount and the computation of the revenue share shall be communicated before the payment date of each month.
4. Instructors and students agree that Eduemore’s sole responsibility is to process payments and pay out instructors in the proportions set forth above. Eduemore is not a party to any transaction between any student and instructor and we cannot be held responsible for any issues arising from such transaction.
5. Instructors are responsible for all income, sales, and other taxes associated with the fees they earn. Eduemore reserves the right to withhold any payment as required by tax authorities as applicable.
6. Eduemore reserves the right to withhold or cancel payments to Instructors if it deems, in its sole judgement and absolute discretion, that the Instructor engaged in behavior that violated any part of this Agreement.
The prices of our educational lessons shall be approved by Eduemore based on the terms of our promotion policy or Instructor Terms. We reserve the right to adjust pricing for educational lessons in any manner and at any time as we may determine in our sole and absolute discretion. Such changes may not apply to lesson fees which were paid prior to the time of the change.
You agree to pay the fees for the educational lessons that you purchase, and you allow us to charge your credit card, debit card, or process other means of payment for those fees. To offer you the most convenient and secured payment methods, Eduemore works with third-party payment processing partners. You may check out our Privacy Policy for more details in this regard.
When you purchase a lesson from Eduemore, you agree to use a valid or authorized payment method. If your payment method fails and you may still be given the access to the lesson which you are enrolling in. However, you must pay us the corresponding fees within three (3) days of notification from us. We reserve the right to disable access to any lesson for which we have not received adequate payment from the students.
From time to time, we may offer trials of paid subscriptions for our students for a specified period without payment or at a reduced rate through promotional codes. These codes and credits may expire if those are not used within the period specified in your Eduemore account. Eduemore reserves the right, in its absolute discretion, to determine your eligibility for such trial, and to withdraw or to modify a Trial at any time without prior notice and with no liability.
In some cases, you may be required to provide your payment details to start the Trial. At the end of such trials, you may be automatically charged for the applicable paid subscription on the first day following the end of such trial. To avoid this charge, you must cancel the applicable paid subscription through your payment settings in your Eduemore account. Cancellations and refunds
Eduemore is not responsible or liable for any refunds the fees for an educational lesson or other purchases on the Service. There are no refund or credits available for partially used periods.
We own the Eduemore platform and Services, including the website, present or future apps and services, and things like our logos, API, code, and content created by our employees which will remain the exclusive property of Eduemore. You should not damage, make alterations or use them without authorization by us. Eduemore reserves these rights:
• We can make changes to the Eduemore Site and Services without notice or liability.
• We have the right to terminate your membership, account, payment, or other affiliation with the Service at any time and for any reason.
• We will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in investigating suspected criminal violations.
• We have the right to remove an instructor or a student at any time, without prior notice, at our sole discretion, should we identify that their account is associated with behavior that is in violation of our rules or guidelines.
• We have the right to reject, cancel, interrupt, remove, or suspend any lesson, comment, or other posted comment at any time and for any reason.
Eduemore is not liable for any damages as a result of any of these actions, and we have no obligation to comment on the reasons for any such action.
In some cases, it may happen that our platform is down either for planned maintenance or for any other reason or we encounter security issues. These are just instances and you must accept that you will not have any recourse against us in any of these types of cases. You shall understand that we provide the Services on an “as is” and “as available” basis.
Use of the Services is entirely at your own risk and we do not make any representations or warranties about the suitability, reliability, availability, timeliness, lack of errors, security, or accuracy of the Services or their content, and expressly disclaim any warranties or conditions, including implied warranties of merchantability and fitness for a specific purpose and non-infringement. Further, we do not make warranty that you will be able to achieve specific results from the use of our Services. We may decide to remove certain features of the Services at any time and for any reason. Under any circumstances, Eduemore will not be held liable for any damages arising from such interruptions or removal of such features. When you use our Services, you may find links to other educational sources and websites that we do not own or control. You must understand that we are not responsible for the content or collection of your personal data. You should refer to and understand their terms and conditions and privacy policies before sharing any personal information with them. Events beyond our reasonable control, such as natural disaster; an act of war, hostility, or sabotage; electrical, internet, or telecommunication outage; or government restrictions, may cause delay or failure of performance of any of our Services. We will not hold responsible for the delay or failure of our performance of any of the Services caused by such an event.You agree to defend, indemnify, and hold us and other Eduemore Parties harmless from all claims, liabilities and expenses that may arise from your activity or violation of these Terms of Service or any terms and conditions of the other Governing Documents. We reserve the sole and absolute right to assume the exclusive defense and control of any matter which is not subject to indemnification by you. You shall cooperate with us in asserting any available defenses in such event.
You are agreeing to enter into a legally binding contract with Eduemore by registering, accessing, or using our Services. If you do not agree to these Terms of Service in conjunction terms and conditions of other Governing Documents, you shall not register, access, or use any of our Services.
Any version of these Terms of Service in a language other than English is provided for your convenience and you shall understand and agree that the English language will control if there is any conflict or confusion.You agree that the Service shall be deemed a service based solely in Sri Lanka and shall not give rise to personal jurisdiction over Eduemore, either specific or general, in jurisdictions other than Sri Lanka. These Terms of Service, together with the Privacy Policy and the other Governing Documents, shall all be governed and construed in accordance with the internal laws of Sri Lanka, without regard to conflicts of law principles. You agree that any legal action or proceeding between Eduemore and you for any purpose concerning these Terms of Service, the Privacy Policy, the other Governing Documents or your use of the Service shall be brought exclusively in a court of competent jurisdiction sitting in Sri Lanka.
Any cause of action or claim, with respect to any of the foregoing matters, must be commenced within one (1) month after the claim or cause of action arises or such claim or cause of action is barred.
These Terms of Service, together with the Privacy Policy and the other Governing Documents, constitute the entire agreement between you and Eduemore concerning the Services provided by Eduemore. If any of these Terms of Service becomes invalid or unenforceable by applicable law, then that provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision. However, the remainder of these Terms of Service shall continue to be in effect.
If we fail to perform any provision of these Terms of Service or any of the other Governing Documents, it shall not be interpreted as a waiver of any provision or right. Neither the course of conduct between the parties nor business practice shall act to modify any provision of these Terms of Service. Eduemore may assign its rights and duties under these Terms of Service or any of the other Governing Documents to any party at any time without notice to you.
Communication between Eduemore and you will be mostly taken place electronically. You shall understand and agree that all electronic communication between Eduemore and you shall satisfy any legal requirements that such communications be in writing.
Any rights of Eduemore which are not expressly granted herein, are reserved.We may update and make modifications to these Terms of Service at our sole discretion. If we make any change, we will notify you using by email or by posting a notice through our Services. Such modifications become effective on the day they are posted unless stated otherwise.
After changes become effective, if you continue the use of our Services, it shall mean that you accept those changes.
